Hola asambleas y gentes usuarias de los servidores de Tomalaplaza
Como bien sabéis, a pocos días de empezar el 15M ya teníamos blogs, listas de correo y otras herramientas telemáticas para dar cobertura al movimiento.
Con ello se buscaba una autonomía para el movimiento que no es nada trivial.
En una lucha social como es la nuestra es imperativo que nos hagamos cargo de nuestros propios servicios, que seamos conscientes de la importancia de los datos que manejamos y del uso que se les da, siempre sin olvidar que la naturaleza de las herramientas que usamos son también parte de la política que hacemos.
No es lo mismo usar software privativo que software libre, no es lo mismo contar con nuestros propios servicios que delegarlos, no es lo mismo mantener nuestros datos bajo nuestro control que dejarlos en manos de quien bien puede sacar beneficio económico de ellos.
Es por esto que en esos primeros días del 15M se decidió asumir el coste de montar semejante infraestructura en tan poco tiempo. Ese coste fue que personas particulares asumieran la titularidad legal de los servicios contratados.
Es hora de liberar a estas personas de esa carga y por ello se hace necesario un cambio de titularidad que conlleva algunos esfuerzos.
Para no generar problemas legales a los actuales titulares, debemos cumplir la LOPD (Ley Orgánica de Protección de Datos) a la hora de realizar el cambio de titularidad, esto es: no podemos mantener los datos personales sin vuestro consentimiento.
Para ello tenemos una fecha limite no negociable, el 1 de Septiembre de 2013, a partir de la cual los actuales titulares no pueden seguir asumiendo la responsabilidad por razones personales.
Por lo tanto,la titularidad de los servidores de Tomalaplaza pasará a la Asociación de Amigos del Café y las Computadoras con CIF G82716879 , asociación sin ánimo de lucro fundada en Madrid, cuya actividad principal transcurrió entre 2000 y 2007 orientada a la promoción y defensa del software libre, el hardware libre y la cultura libre en la sociedad, para lo cual llevó a cabo numerosas actividades: charlas, talleres, cine-forums, actividades de calle. Para el traspaso de titularidad es necesario que cada usuario (individual o colectivo) de cualquiera de los servicios dé su conformidad expresa mediante respuesta positiva a este mensaje. Al mismo tiempo, advertir de que pasados 30 días sin oposición a la transferencia/cesión, se entenderá que prestan conformidad.

Transcurrido el plazo de treinta días desde la aceptación de estas condiciones sin recibir negativa fehaciente de su parte, entenderemos que consiente dicho tratamiento, sin perjuicio de su derecho a proceder a la revocación del mismo en cualquier momento, mediante comunicación escrita dirigida a la dirección electrónica aacc@riseup.net
La Asociación de Amigos del Café y las Computadoras gestionará la información de los usuarios como se ha hecho hasta ahora, garantizando la privacidad y de acuerdo a la Ley de protección de datos.

Dear assemblies and users from Tomalaplaza servers (which include takethesquare)
Since the beginning of 15M/Indignados movement we set up a server with blogs, mailing lists and other online tools that would empower the movement.
Having our own server meant to provide autonomy to the movement, which is nothing trivial.
In a social struggle like ours, it is important that we take charge of our own services, to be aware of the importance of the data that we manage y its use, so that we never forget that the tools that we use are part of our politics.
It is not the same to use free software than privative software, is not the same to have our own services that to delegate them, it is not the same to to manage our own data and have them under our control than to leave them in the hands of others that can take profit from them.
For those reasons, in the beginning of the 15M, it was decided to assume the work of building such infrastructure en a really short time.
This meant, that individuals had to take care of the legal ownership of the services hired (servers).
Now is the time, to release those people from this burden, so it is necessary to transfer the ownership from the original holders and this entails certain efforts.
In order not the create any legal problem to the current holders, we must accomplish the LOPD (Spanish Data Protection Act), which means that we cannot keep any of your data with out your agreement.
The deadline is 1 of September, from this date on the current holders cannot continue assuming that responsability for personal reasons.
Therefore, the ownership of the server of Tomalaplaza will be transfer to Asociación de Amigos del Café y las Computadoras with CIF G82716879, a non-profit association, founded in Madrid and its activity took place between 2000 and 2007. The activity was oriented to promote in the society the defense of free software, free hardware and free culture, for which it carried out many activities: talks, workshops, film-forum, meetings. To make this transfer possible is necessary that each user (person or collective) of the services agrees explicitly by giving a positive response to this mail. At the same time a warning about the fact the after 30 days without showing disagreement will be understood as a positive answer.
